MYSHAKESPEARE PRIVACY POLICY

EFFECTIVE DATE: July 24, 2019

1. Purpose of this Policy

myShakespeare cares about and is committed to protecting your privacy.  We created this Privacy Policy (“Policy”) so you can understand how your personal information is treated as you use and visit the myShakespeare website, content and related services (collectively, the “Service”).  This Policy describes how we collect, use, store and share your information in connection with the Service, as well as the choices you can make about your data and your rights under applicable data privacy laws.  The provisions of our Terms of Service also apply to this Policy. All references to “we”, “us”, “our”, or “myShakespeare” refer to Paradigm Education, LLC, a California limited liability company. All references to “you”, “your”, or “user” refer to the user of the Service.  If you use the Service as part of a school, third-party service or other entity that has an agreement with myShakespeare, the terms of such agreement may also apply to our collection, use, storage and sharing of your information in connection with the Service or the choices you can make about your data.

2. IMPORTANT NOTICE TO USERS LOCATED IN THE EUROPEAN UNION:

If you are located in the European Union and you are under the age of 16 (or such lower age of consent as is required under the applicable law of the Member State where you are located), you may not access the Service unless your parent or legal guardian has given us his or her affirmative consent to your use of the Service. Do not use or visit the myShakespeare Service until your parent or guardian has provided his or her consent.

3. Information we collect about you

We collect only the minimum amount of personal information necessary for the purposes described in this Policy, unless you choose to provide more.  We encourage you to only provide the amount of personal data that you are comfortable sharing.  However, some or or all of the features of the Service may not be available if you choose not share certain personal information with us.  

Information you provide to us

When you sign up for an account through the Service, you will be required to provide us with information that is or may be considered personally identifiable information, such as your name, email address, information about your teachers or students, school, school district, grade, classes and other related information.

Information we collect as you use the Service

We may collect additional information from you as you use the Service, such as:

  • Your notes and annotations
  • Metrics regarding how much time you spend on specific features of the Service (i.e., videos, reading or interacting with the text, or pop up notes, etc.), when and how frequently you use the Service or specific features, and other similar data about your use of the Service
  • Your responses to self-study questions and other similar assignments
  • Information regarding which questions and assignments you have completed

Information we collect from your school, teachers or other third parties

In addition to the information about you that you provide to us or that we collect through your use of the Service, we also collect information (which may include personal data) about you from third parties, such as your teachers, your school, third parties that provide services to us, or through the integration of our services with other third-party services like Clever. This includes information such as your name, grade, school, school district, classes, information about your teachers or students and other similar information.

Anonymous data that we collect

We may also collect anonymous information that does not identify you.  For example, we may use third-party services, such as Google Analytics, which use cookies to collect generic, anonymous information that does not identify you. We use this information to better understand how users interact with the Service and to improve your user experience.

Do-Not-Track signals

We do not track you or collect your information across third-party websites or online services. Thus, we do not receive Do-Not-Track signals or similar signals.  If we receive any Do-Not-Track signals, we will not comply with them, because that is not a part of the functionality of the Service.

4. How we use your information

As described throughout this Statement, we use and process your personal information for a number of purposes, including to:

  • Provide the Service to you
  • Improve the functionality of the Service
  • Customize or personalize the Service for you
  • Communicate with you in connection with providing the Service to you
  • Provide user support to you
  • Fulfill our legal obligations

5. Legal basis for processing your information

We only collect and process your personal information where we have lawful basis to do so. For example, we process your personal information with your consent, where you provide your affirmative consent.  We also process your personal information as necessary to perform our contractual obligations to you (e.g., to deliver services, functions or content that you request through the Service).  We also process your personal information based on legitimate interests, such as providing the Service, fulfilling our obligations under applicable law and our obligations to third parties like your school, so long as such legitimate interests are not overridden by your fundamental rights and freedoms. 

6. How we share your information

We do not sell or share your personally identifiable information with advertisers or marketers. We also do not share your personally identifiable information with other third parties except to the extent that it is in furtherance of the Service, or when you choose to do so (as described below). For example, we may share personal and other information with your teachers or school, in order to provide the Service to you, such as information about which self-study questions, quizzes and other assignments you have completed.

Information shared by you

You also may be able to voluntarily share your information with your teachers, classmates, or other third parties, as well as by email, through third-party services or through other similar means. For example, you may be able to export and share your notations and other information with your teacher.  In these cases, you should only share the amount of personal information that you are comfortable sharing.

Our personnel, vendors and service providers

In order to provide the Service and to improve the functionality of the Service, we may disclose your information to our personnel, including our employees, contractors, agents, vendors and other similar persons or entities, to the extent they need to know such information.  These third parties include software and technology companies who provide services in furtherance of our provision of the Service, such as companies that provide backups of the Service and secure hosting services, as well as platforms like Google and Clever that assist us with offering the Service to you. If you log in to myShakespeare.com with Google SSO, your Google email address and name will be associated with your user account on MyShakespeare.com.

Other third parties

Notwithstanding anything in this Policy to the contrary, we reserve the right to disclose your personal information if we believe in good faith that such action is necessary or required (a) under applicable law; (b) to respond to governmental requests (see below); (d) to protect our operations or those of our partners or affiliates; (d) to protect the rights, privacy, safety, remedies available to, or property of myShakespeare, our affiliates or partners or you; or (e) to prevent an emergency involving danger of death or serious physical injury to any person.

Government requests

We may receive requests from government agencies to obtain information about you. We may disclose your information in accordance with such requests if we believe such disclosure is warranted.  We will strive to notify you if we receive government requests for your personal data, to the extent permitted by applicable law.

7. Third-party services beyond our control

The service may offer or be used in connection with integrations with other services provided by third-parties.  For example, you may be able to sign on to the Service directly from a third-party application or service like Clever.   We encourage you to review the data and privacy practices of such third parties.  You understand and agree that we have no control over and shall not be responsible for the information, services, or data practices of any third party, except as required by applicable law.

8. Your choices and rights

We provide you with many choices about the collection, use and sharing of your data, as described below.

Accessing and correcting your information

You have the right to request access to the personal information that we have about you by contacting us at info@myshakespeare.com. If you make such a request, we will provide you with a copy of the personal data that we have about you, but we may ask you to verify your identity first.  If you believe that the information we have about you is incorrect or incomplete, you may also request that we update your information. You may also request that we send you a copy of your personal information in an electronic format, which you may transmit in order to use such information in another service.

Deleting your information

You may also contact us at info@myshakespeare.com to request that we delete your personal data.  However, we may retain your information if it is necessary for archiving purposes, in the public interest, to comply with legal obligations, to resolve disputes, or to defend against legal claims.

Objecting to, limiting or restricting the use of your information

You may also contact us at info@myshakespeare.com to request that we temporarily or permanently stop processing all or some of your personal data or to object to the processing of your personal data.

Right to lodge a complaint

If you are unhappy with the way we are processing your personal data, you have the right to contact and lodge a complaint with your local Data Protection Authority or another applicable supervisory authority.

Right to withdraw your consent

If we process your personal data based on your consent, you may withdraw your consent at any time by contacting us at info@myshakespeare.com.

9. How we store your information

We only retain your personal information for as long as is necessary to provide the Service or for any other lawful purpose for which we collected the information, except as required or permitted by applicable law. For example, we retain and use your personal information as needed to comply with our legal obligations, resolve disputes and enforce our agreements.

10. How we protect your information

We value your privacy and use reasonable efforts to secure your personal information and to prevent the loss, misuse, alteration, destruction and unauthorized access of your information.  For example, we use reasonable technical safeguards such as encryption, security updates and secure hosting services provided by industry leading third-party vendors in order to secure your personal information.

11. EU Users

For users from the European Union, we comply with the EU General Data Protection Regulation (EU) 2016/679 (the “GDPR”)  as set forth by the European Union regarding the collection, use and retention of personal data from European Union member countries.

12. International data transfers

The Service is based in the United States. By submitting, uploading or posting your personal data through the Service you are consenting to the storage, use, processing, and, if applicable, transfer of your personal data to or in the United States.

13. Changes to this Policy

We reserve the right to change or update this Policy from time to time.  If we materially update this Policy, we will make reasonable efforts to notify you that this Policy has been updated, such as sending an email notification to the email address we have on file for you, if any, or posting a notice to our website.
